The purpose of these General Conditions is to regulate the conditions of use of the Website www.nfnatcane.es (hereinafter, “the website”), which is owned by NUTRICIÓN Y FORMACIÓN CANINA, S.L. (hereinafter, NFNATCANE), with CIF B34210666, address at Calle Málaga 3 (Polígono San Antolín) 34004 (Palencia), and registered in the Mercantile Registry of Palencia – volume 352 to Folio 6, sheet P-4422 Registration 3ª., with which you can contact through nfnatcane@nfnatcane.es and telephone 653151942.

1. Access conditions.

The purpose of this website is to provide information about our activity, as well as our offer of products and services. Its use implies full acceptance by the User of these conditions, so, if you do not agree with the content of the same, you must refrain from making use of this website, as well as the services offered therein. NFNATCANE reserves the right to make any modifications it deems appropriate, being able to modify, delete or include, without prior notice, new content and/or services, as well as the way in which they appear presented and located and the conditions of use of the website.

The User accepts that the access and use of the website and the contents included therein takes place freely and consciously, under their sole responsibility, and consequently undertakes to:

– Not use the website for carrying out activities contrary to the law, morality, public order, in general, and make a lawful and honest use in accordance with these General Conditions, as well as refrain from carrying out any act that could damage, disable, overload or deteriorate the website and/or prevent the normal use and utilization by the rest of Users.

– Not manipulate or alter any content of the website without the express and written consent of its owner. Any alteration, modification or manipulation without the consent of its owner, exempts the latter from any responsibility.

– Not reproduce, copy, distribute, publicly communicate, transform or modify the contents, unless there is the mandatory authorization of the owner of the corresponding rights or it is legally permitted; as well as suppress, evade or manipulate the Copyright and other identifying data of the rights of NFNATCANE or its owners incorporated into the contents, as well as the technical protection devices, or any information mechanisms that may contain the aforementioned contents.

– Not introduce or disseminate in the website data programs (viruses or any type of software of a harmful nature) susceptible to causing damage to the website.

NFNATCANE does not guarantee the availability and continuity of the website nor is it responsible for any damages that may occur, nor for technical defects, including viruses or other harmful elements, whatever their nature, derived from the use of information and materials contained in the website.

2. Use of cookies.

In order to provide a better service, NFNATCANE may store small information files called cookies on the User’s computer, used for the proper functioning of some of the services offered, as well as to perform usage statistics, diagnose problems on the website, and for the administration of some of the services offered. 3. Responsibilities.

The User will be liable for damages of any nature that NFNATCANE or any third party may suffer as a result of the breach of any of the obligations to which it is subject by these General Conditions.

NFNATCANE does not assume any responsibility nor does it carry out any control over the possible hyperlinks contained in the website to external content; however, it will remove those links that include illegal content as soon as it becomes aware of it.

4. Intellectual and Industrial Property.

The User acknowledges that all the contents of the website and, specifically, all the information and materials, the structure, selection, arrangement and provision of its contents, programs and application development used in relation to them, are protected by intellectual and industrial property rights owned by the owner of the website or, where appropriate, by third parties.

In no case does access to them or their use by the User imply any type of waiver, transmission or total or partial assignment of said rights, nor does it confer any right of use, alteration, exploitation, reproduction, distribution or public communication on said contents without the prior and express authorization specifically granted for this purpose by NFNATCANE or the third party owner of the affected rights.

NFNATCANE owns the elements that make up the graphic design of its website, the menus, navigation buttons, the code, the texts, images, textures, graphics and any other content of the website or, in other cases, has the corresponding authorization for the use of said elements.

All trademarks, trade names or distinctive signs shown on this page are the property of NFNATCANE and/or third-party companies. It is prohibited to use or download them permanently, copy or distribute them by any means without the mandatory consent of their owner.

In the event that any User or a third party considers that any of the contents has been introduced on the website in violation of their Intellectual or Industrial Property rights, they must send a notification to NFNATCANE identifying themselves and the owner of the intellectual or industrial property rights allegedly infringed, providing title or accreditation of the representation of the aforementioned rights.

6. Contracting conditions.

6.1 Purchase procedure.

For the purchase of the products offered on the website, if you are a professional it is necessary to previously proceed to the registration of the user. You can also make occasional purchases without registering. The processing of personal data that you provide will be adjusted to the provisions of clause 5 of these general conditions, committing the user to provide this information truthfully and completely.

NFNATCANE reserves the right to modify the commercial offer presented on the website (related to products, prices, promotions and other conditions) at any time.

NFNATCANE will make every effort within its means to offer the information contained on the website truthfully and without typographical errors. In the event that at some point there is an error of this type, it will proceed immediately to its correction. If, there being a typographical error in any of the information referring to our products, a client has made a purchase decision based on said error, NFNATCANE will notify the client of said error, the client having the power to rescind their purchase without any cost on their part or adhere to the conditions and/or price newly communicated. The photographs displayed are merely indicative and not contractual, and there may be variations.

6.2. Prices and payment method.

The prices indicated on the website include Value Added Tax (VAT) and will be expressed in euros. The prices that appear in our sales documents are guaranteed during the duration of their validity, except for typographical errors.

The products purchased must be paid for by means of one of the formulas that NFNATCANE makes available to the client:

For professionals there are only two forms of payment and it is through bank card or bank transfer to the account indicated during the purchase process.

The rest of the users have the following means of payment at their disposal:

• Bank card

Visa and MasterCard have developed a secure payment system in an SSL Internet environment. The Secure Electronic Commerce system is based on the fact that the card issuer (bank or savings bank) identifies the cardholder before authorizing payment over the Internet. NFNATCANE is attached to this security protocol, so, once the product to be purchased has been selected and the number of your card has been entered, a window of the issuing entity opens that requests your identification.

Your card details and password are protected by this security system from the moment of their introduction. This window is outside the control of NFNATCANE, being the responsibility of your Issuer any incident that may arise with it, and you should contact your entity if you are in this hypothetical case.

6.3 Method and cost of shipping.

In principle, all the products described in our online store will be available, except those that are shown as “unavailable” in the product sheet. In the event that the stock of a product runs out at the time of placing your order, and we have not been able to update this information on the website, we will contact you as soon as possible to offer you a similar product or the refund of the corresponding amount.

When dealing with various warehouses of origin and in the case of orders of several articles, these may be sent in different packages, without additional cost, with the aim of reducing the delivery time of the same as much as possible.

NFNATCANE offers shipments of its products to the Iberian Peninsula, Balearic Islands and Portugal, through different transport agencies. Due to logistical problems, shipments are not made to the Canary Islands, Ceuta, Melilla, Andorra or countries not explicitly mentioned.

Shipping rates are specified during the purchase process, with shipments to mainland Spain being free from 8kg with delivery service up to 7 days, and delivery service with cost in deliveries of 1 day, 2-3 days (working days) in mainland Spain (May add 1 or 2 days depending on dates, destination or agency load)

• FREE delivery service up to 7 working days (May add 1 or 2 days depending on dates, destination or agency load) with a surcharge of 3.50 euros for shipments less than 8 kg (in Peninsula and Portugal) and 12.10€ for shipments less than 30kg (in Balearic Islands)
• CTT STANDARD delivery service in 2-3 days (working days) €0.90 (May add 1 or 2 days depending on dates, destination or agency load) (delivery service only available in mainland Spain)
• CTT EXPRESS delivery service in 1 day (working day) €2.80 (May add 1 or 2 days depending on dates, destination or agency load) (delivery service only available in mainland Spain)
• SEUR EXPRESS delivery service in 1 day (working day) €2.40 (May add 1 or 2 days depending on dates, destination or agency load) (delivery service only available in mainland Spain)
• SEUR STANDARD delivery service – COLLECTION POINT in 2-3 days (working days) €2.00 (May add 1 or 2 days depending on dates, destination or agency load) (delivery service only available in mainland Spain)

NFNATCANE reserves the right to modify the transport company and/or its rates without prior notice.

Delivery times are, under normal conditions, (may add 1 or 2 days depending on dates, destination or agency load)

On special dates such as December, January, Black Friday, sales, Easter, eve of public holiday, bridges, please place your order well in advance.

Deliveries to the customer’s address are always made from Monday to Friday, except holidays. Weekends and holidays do not count as days in the delivery times shown.

NFNATCANE prepares orders received until 10.00 a.m peninsular on a working day and always from Monday to Friday, to be collected and transferred to the warehouses of the different transport agencies. Orders placed after 10 a.m will be prepared and sent the following working day, always from Monday to Friday (not a holiday). When orders are placed on the eve of a holiday, the delivery time may be increased.

The transit of shipments begins around 8 p.m. (depending on the agency)

We do not have a delivery service with time slots or agreed times, it is the transport agencies themselves who determine it according to their routes and delivery destinations, with deliveries in the morning in some destinations and in the afternoon in other destinations.

The delivery times previously stated are applicable solely and exclusively in the Iberian Peninsula. The Balearic Islands and Portugal are excluded.

We do not authorize under any circumstances, the delivery of our orders, if it is not to a physical person, since the orders must be reviewed at the delivery and on the other hand, by not being delivered to a physical person, it can be stolen. If the customer asks the delivery person to leave it in the street, door of his house, etc.. we are not responsible in the event of an incident or theft.

In the case of return of the order for reasons beyond us or the transport company (customer absent at the address, customer does not pick up the package from the selected collection point, etc..) will proceed with the return of the returned order, less the return costs that will vary according to the kgs.

In the case of shipments to professionals, orders will be sent through the transport company SCHENKER or PALLETWAYS and will leave our warehouse every Tuesday and Thursday, not holidays. Delivery times will depend on the routes stipulated by the corresponding transport agencies. In the shipment of each Tuesday will be accepted orders placed between Thursday and the previous Monday at 12 hours (peninsular Spain). In the shipment of each Thursday will be accepted orders placed between Tuesday and the previous Wednesday at 12 hours (peninsular Spain). In the pallet shipments for professionals can not be set a specific delivery time, to the extent that deliveries will depend on the routes stipulated by the corresponding transport agencies.

6.4 Guarantee of the products.

NFNATCANE guarantees its products, in the legally established terms, for a period of 1 year from the date of delivery.

The customer must inform NFNATCANE of the lack of conformity within two months from when he became aware of it.

Deficiencies caused by negligence, blows, misuse or improper handling, unsuitable tension when appropriate, or materials subjected to wear and tear due to normal use will be excluded from the guarantee.

When the use of the guarantee is justified, the repair, replacement of the article, reduction or return will be chosen, in the legally established terms.

The guarantee will lose its value in cases where:

• Some of the data of the same or of the purchase invoice are modified, altered or replaced.
• If both the identification number and the guaranteed product itself are manipulated without the knowledge of the marketing entity.
• If the purchase invoice is missing.

If the necessary repair is not covered by the warranty, under the terms established by current regulations, the customer must bear the costs of both repair and shipping.

6.5 Right of withdrawal.

In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, the buyer has a period of 14 days, counted from the receipt of the product, to withdraw from the contract without the need to indicate the reasons. It is an essential requirement that both the original packaging and the product are in perfect condition, have not been manipulated or opened, and do not present defects or deterioration due to external events or other circumstances that result in the impairment of the product.

All products leave the warehouse in perfect condition, please check your order when it is delivered to you (in front of the courier).

IMPORTANT:

When you receive your order, make sure it is in perfect condition, otherwise REJECT THE SHIPMENT and contact us at incidencias@nfnatcane.es so that we can replace it. (If you accept a visibly broken order, the agency’s insurance is not responsible) and we will not be able to claim it.

Article 60. Reservations.

1. The recipient must express their reservations in writing to the carrier or its auxiliaries, describing in a general way the loss or damage at the time of delivery. In the case of non-manifest damages and losses, the reservations must be made within the following seven calendar days after delivery.

When reservations are not made, it will be presumed, unless proven otherwise, that the goods were delivered in the state described in the consignment note.

Contact NFNATCANE by sending an email to nfnatcane@nfnatcane.es on the same day that the order is delivered to you, indicating the order reference number and attaching a photo of the incident (breakage) and a photo of the delivery note or PDA where the incident has been recorded. In the event of a breakage incident, it is essential to keep the original packaging (aluminum bag and protective bag), and keep the product as it has been delivered by the transport agency and without opening it.

Shipments include a high-resistance raffia bag protection, in which the aluminum bag is introduced to protect it from dirt and external transport factors.

Also, an additional packaging service with a box is available, for the customer who requests it on the order form.

To exercise your right of withdrawal, the customer may contact NFNatcane, through the address nfnatcane@nfnatcane.es, providing their name, address, product purchased and date of receipt, which, if applicable, and after verifying that the goods have not suffered damage, will refund the amount paid for the product. If you prefer, you can use the withdrawal form provided on this website and download the withdrawal form.

The returned order must be delivered together with the delivery note and, where applicable, the invoice issued by NFNATCANE.

The expenses derived from the return will be borne by the buyer, as established by the regulations.

The amount derived from the return costs may vary depending on the quantity and weight of the order, as well as the transport agency that returns the order.

Returns are made by bank transfer, except for orders paid by card.

7. Confidentiality.

All information that any of the parties communicates or provides to the other or to which any of them have access, will be considered confidential and may not be disclosed, shown, reproduced, copied, discussed with third parties, or used by any of the parties for purposes other than those that motivated its communication.

8. Applicable law and jurisdiction.

These General Conditions shall be governed by the provisions of Spanish law. For any questions that may arise between the parties in relation to the interpretation and execution of this document, both parties expressly agree and waive any other jurisdiction that may correspond to them, to the jurisdiction of the Courts and Tribunals of Palencia, except in the case of consumers, in which case they will be those corresponding to their domicile.
